
BDA fails again- HC upholds quashing of land acquisition process

Bengaluru: Ten years after a single-judge bench quashed the land acquisition process of the Bengaluru Development Authority (BDA) for a delay of 30 years, a division bench of the High Court has upheld the quashing. “Since the land acquisition proceedings were not concluded within a reasonable time, the learned Singe Judge has therefore rightly quashed the same.
For the aforementioned reasons, we do not find any ground to differ with the view taken by the learned Single Judge,” the Division Bench of Justice Alok Aradhe and Justice S Vishwajith Shetty said in their judgment filed on an appeal filed by the BDA. Amarlal V Talreja is the owner of land at Uttarahalli hobli, Bengaluru South Taluk. It was notified for acquisition by the BDA in 1988. A final notification was issued in 1991.
“However, after issuance of final notification for a period of 30 years no effort was made by the Authority to conclude the land acquisition proceedings,” the court noted. Talreja, therefore, filed a writ petition before the HC seeking quashing of the notifications in 2019.
